    Default Gearbox 3 days out of warranty

    Hi All

    Looking for some advice please

    As title says my gearbox has developed a whine in all gears and is only three days out of warranty so I took it to Arnold Clark who car had service plan with to get it checked, as soon as I was in the door I was told I would need to pay £65 for a diagnostic to be done but couldn't be done at their place for another 11 days, was told I could drive my car to one 6 miles away and have the diagnostic check done there that same day so took that option and headed over, left my car with them from 8AM and received a call at around 12:40PM to say that the "technician" had checked over my car and it was as I thought needed a new gearbox I explained about warranty and they said they would contact Vhall explain situation and get back to me, few hours later I got another call to say that Vhall had offered to pay %80 of new gearbox costs and I was to pay the remaining %20 £540 according to AClark, told them not happy having to pay anything and to talk to Vhall again and was told that Vhall would still only agree to pay %80 and if I wanted to I could contact Vhall myself so I did, phoned them and they have said to leave it with them as they are trying to get AClark to pay the other %20 for some reason.
    My question is this; what can I do regarding not paying the %20 as car is only three days out of warranty and what can i do if they say i have to pay.

    How long have you had the car, and how many miles on the clock.

    I would say be happy Vauxhall are paying 80% of the costs.

    I have to agree.

    Whilst a total bummer for you, 3 days out of warranty might as well be 3 years, its still out of warranty and you've done well to get 80% out of them. It would cost roughly the same just to refurb your box, personally if they don't come good just suck it up safe in the knowledge your box is a brand spanker.

    I guess they could argue if it's out of warranty it's out of warranty have to draw the line somewhere no point in having an end date if your going to do it anyway. So I'd pay the 20% and be thankful they will pay the rest. But I get were your coming from a real bummer

    Cheers for the replies

    I have had the car for 2 years and it has 36k on the clock, i understand what you are saying about warranty being up but do you honestly think a gearbox should only last 3 years?, also the M32 box has known issues with oil not getting to end bearing surely this has to be taken into consideration.

    Also is the gearbox oil changed at any service on the car ie major service, if not why is it mentioned in the service book?

    your right yes, I had the same for my turbo going after 22k just out of warranty it is what it is.

    and no not unless you ask for it to be changed the nurburgs you do.

    I got 80% on my old insignia when the rear diff went **** up and that was only just out. I was happy enough as they could have said no.

    Your warranty is 3yrs 60k not 3yrs + 3days and 60k unfortunately

    I had a turbo fail a few weeks out of warranty and went back to the dealers for a price, to be fair they called Vauxhall and got them to agree to 90% goodwill payment so I was left with £90 to pay which I was more than happy to do so.

    Bear in mind that if you pay some towards it then you have warranty on the item, but if they goodwill it totally you don't have any cover.
    £540 seems a bit steep especially as you could probably get the box repaired for that at one of the box specialists.

    PS - the gearbox oil is not scheduled to be swapped, its a fill for life (but most of us swapped ours out for some decent stuff from places such as Opie Oils)

    Gearbox should last more than 3 years, and does on almost any other car.

    However, no manufacturer is going to turn round and say "yes our <insert part name here> is ****, please have a new one on us" - as they'd be out of business PDQ for obvious reasons.

    The fact they're agreeing to pay 80% is pretty decent and is virtually saying they're design is **** without actually spelling it out so i'd be happy if I were you.

    You are obviously aware of the M32 issues so its a bit late to start complaining really.
